Abstract

Perkara dispensasi adalah perkara yang tidak mengandung sengketa yang ditetapkan pengadilan berupa penetapan. Meskipun angka perceraian yang sebelumnya mengajukan permohonan dispensasi nikah tidak menunjukkan angka yang tinggi akan tetapi sangat menarik untuk di analisa lebih jauh. Berdasarkan data yang ada bahwa rentan waktu  antara perkawinan (dikabulkan permohonan dispensasi nikah) dan perceraian  sangat singkat kurang lebih dua tahun. Pertimbangan hakim di Pengadilan Agama (PA) pada perkara dispensasi nikah umumnya berdasar asas ataupun kemanfaatan. Dalam hukum islam asas kemanfaatan adalah asas yang menyertai asas keadilan dan kepastian hukum, yaitu segala pengambilan keputusan hukum yang ditimbang dan didasarkan pada manfaat atau tidaknya suatu keputusan tersebut. Tentunya asas kemanfatan ini mendasarkan pada pertimbangan hakim dalam memberikan putusan hukum agar hukum yang dihasilkan memberikan kemanfaatan bagi para pihak yang mencari keadilan dan kepada masyarakat luas. Peran hakim dan sekaligus hukum dibutuhkan oleh masyarakat dalam memberikan kemudahan dan jalan keluar yang terbaik atas persoalan yang terjadi dalam masyarakat itu sendiri.
